Applicability
This Privacy Policy applies to www.gc-solutions.net (our 'Company website') and G-Cube related communications and services ("Services").
This policy also applies to all G-Cube personnel, Outsourced / temporary staff, working for G-Cube operating units, and wholly owned subsidiaries worldwide.
Data Controllers and Contracting Parties
G-Cube Webwide Software Pvt Ltd ('G-Cube') is the Controller of your personal data provided to, or collected by or for, or processed in connection with our Services - you are entering into the User Agreement with G-Cube.
As a visitor to our Company website or recipient of our marketing communications, the collection, use and sharing of your personal data is subject to this Privacy Policy (which includes other documents referenced in this Privacy Policy) and updates.

However, to request for a sample of our products / services or to request a personal demo, we will need you to provide basic personal data including your name, company name, email ID and contact number.

We receive personal data about you when you access the websites or use the services of our business promotion partners, such as e learning industry websites, and others

Our Services
Your personal data stays with G-Cube.
We don't sell or rent your data to any other party and we don't share prospective client's data with any third parties, including service providers. For employees we share the data with third party after contracting with them for internal processes (like HRMS, Payroll).
Disclosures Required By Law
We may need to share your data when it is required by law.
We may need to disclose information about you when required by law or where we believe that disclosure is required to:
(i) Prevent, investigate or take action regarding actual or suspected illegal activity
(ii) Assist government enforcement agencies in doing the above
(iii) Enforce our agreements with you
(iv) Investigate and defend ourselves against third-party claims or allegations
(v) Protect the security or integrity of our Services (such as by sharing with other organisations facing similar threats), or
(vi) Exercise or protect the rights and safety of G-Cube, our Clients, Learners or others.
Sale, Merger or Change in Control
We may share your data when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy.
We can also share your personal data as part of a sale, merger or change in control, or in preparation thereof. The entity that buys us (or part of our business) will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.

Data Retention
We keep your personal data for as long as you are okay to hear from us.
We need your personal data to reach you to provide information on our products and services. We will retain your personal data (provided to us by you or others) and reach out to you so long as you do not object to our contact. Should you feel you no longer want to be contacted about our learning management solutions, you may choose to unsubscribe.

You have choices about how your data and used. You can access or delete your personal data.
We provide you with choices about the use of your data, including deleting or correcting your data, as follows:
(i) Change or Correct Data: You can ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.
(ii) Delete Data: You can ask us to erase or delete all or some of your personal data (e.g. if it is no longer necessary to provide Services to you).
(iii) Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data (e.g. if we have no legal right to keep using it) or to limit our use of it (e.g. if your personal data is inaccurate or unlawfully held).
(iv) Right to Access and/or Take Your Data: You can ask us for a copy of your personal data, and can ask for a copy of personal data you provided in machine readable form.
(v) Right to Opt out of Marketing Communication: You can opt-out of receiving marketing communications about G Cube by following the instructions for opt-out in the relevant marketing communication, or by contacting us.

Security
We monitor for and try to prevent security breaches.
We have security safeguards designed to protect your data. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
Cross-Border Data Transfers
We process and store your data outside your country.
We process data primarily in India, and rely on legally provided mechanisms to lawfully transfer data across borders. Countries where we process data may have laws which are different, and potentially not as protective as the laws of your own country. To ensure that your personal data is adequately protected when transferred outside your country, we adhere to the requirements prescribed by these mechanisms.
G-Cube's sales outreach requires for data to flow from the European Union (EU) to our Marketing & Sales team based in India. To ensure that EU personal data is adequately protected when transferred outside the EU, the General Data Protection Regulation (GDPR) mandates that such transfers take place using certain legal mechanisms described here.
In many cases, we will use European Com-approved Standard Contractual Clauses or equivalent as a legal mechanism for data transfers out of the EU. These clauses are contractual commitments between parties transferring personal data (for example, between G-Cube and its data suppliers both inside and outside the EU), binding them to protect the privacy and security of the data.

Lawful Bases for Processing
We have lawful bases to collect, use and share data about you. You have choices about our use of your data.
We will only collect and process personal data about you where we have lawful bases. Lawful bases include Consent (where you have given consent), Contract (where processing is necessary for the performance of a contract with you e.g. to deliver the G Cube Services you have requested) and 'Legitimate Interests'.

We may process your personal data for the purposes of our legitimate interests or for the legitimate interests of third parties (e.g, our Clients), provided that such processing shall not outweigh your rights and freedoms. For example, we may process your personal data to:

3. Enable or administer our business, such as for quality control, consolidated reporting, and customer service
4. Manage corporate transactions, such as mergers or acquisitions
